TERMS OF USE In visiting the Portal, the user agrees not to use it and/or any of its contents for any unlawful activity, or use it in any way that would violate any of the terms and conditions stated in this ULSA. Acceptance of Terms The Bureau of Product Standards (BPS) welcomes you to its "Standards and Conformance (S&C) Portal". The Standards and Conformance Portal herein referred to as the "S&C Portal" is also the official website of the BPS. It is owned and operated by BPS under the Department of Trade and Industry (DTI), Republic of the Philippines. The services that this Portal provides you are subject to the following Terms of Use ("TOU"). BPS reserves the right to update the TOU at any time without notice to you. The most current version of the TOU can be viewed and reviewed by clicking on the "Terms of Use" hyperlink located at the bottom of our web pages. By using the whole Portal or parts of it through accessing information, materials, and data contained within the Portal, the user hereby agrees to accept the following terms and conditions contained in this Terms of Use (TOU). Moreover, the user agrees not to use it and/or any of its contents for any unlawful activity, or use it in any way that would violate any of the terms and conditions stated in this TOU. Unless otherwise specified, the services in the S&C Portal are for your personal and non-commercial use. You may not modify copy, distribute, transmit, reproduce, publish, license. Transfer or sell any information or services obtained from the Services. Description of Service The S&C Portal is an online facility that offers an easy access to a wide range of information on standards, regulations, and conformity assessment activities in the Philippines and other World Trade Organization (WTO) member countries. As the Philippines’s National Standards Body and the country’s WTO Technical Barriers to Trade Enquiry Point, BPS seeks to enhance the awareness of its stakeholders on Philippine National Standards and proposed technical regulations of other countries by providing them information related to standards and technical regulations as well as involving them in the activities related to enhancing compliance and conformity to standards. We see the value of using current technologies to deliver this strategy through online services that our stakeholders could avail. The use of internet as a primary technological medium was founded on three pillars of strategy: 1.to inform stakeholder about Standards and Conformance 2.to involve stakeholder in the effort to increase compliance to standards and imposed technical regulations 3.to interact with the agency in this common objective The S&C Portal is a virtual one-stop information center that houses several facilities that aims to provide up-to-date and relevant information about Standards and Conformance. With 20 enhanced facilities, we believe that we are not only bringing BPS closer to its stakeholders but also providing an alternative medium in which the business community can involve and interact with BPS. To name a few, stakeholders can now avail of these services 1.Standards Catalogue 2.WTO TBT and Standards Alert Service 3.Download areas 4.Forums 5.Web Store 6.Online Databases 7.Help Desk More importantly, the S&C Portal enables all stakeholders to provide comments/inputs on draft standards and proposed technical regulations issued by WTO members. Registration Information about Users This site requires registration to use its online services/functions, such as posting a comment on a specific content, draft standards and WTO TBT notification, subscription to alerts, access to online helpdesk, online ordering and payment. At registration we specifically ask you for personal information. Certain information is mandatory – such as your name, valid email address, gender, username, password, and user type. We would also appreciate you filling out the rest of the registration form to enable us to conduct a thorough evaluation. In fulfilling your registration, you signify that you are of legal age and are not a person prohibited from using services under the laws of the Republic of the Philippines or other applicable laws. You are also committed to 1.) provide true, accurate, current and complete information about yourself as driven by the Account Login Registration Form and (b) maintain and promptly update your account information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or BPS has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, BPS has the right to suspend or terminate your account and refuse any and all current or future use of any online services/ Upon completing the registration, you will receive an e-mail notification detailing your created username and password and link which you will be prompted to link to activate your account. After activation, you are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree and are committed to immediately notify BPS of any unauthorized use of your password or account or any other breach of security. BPS cannot and will not be liable for any loss or damage arising from your failure to comply with this clause. Intellectual Property Policy All materials contained in the Portal, including but not limited to the site design, news articles, directories, photographic images, and the DTI logo are protected by copyright laws. Unless otherwise specified, all contents in the portal are copyrighted property of BPS and/or the government of the Republic of the Philippines. Disclaimer Regarding Accuracy of Information and Usage of Data Visitors and users of the Portal are advised that information contained within the Portal is assumed to be accurate. However, errors can occur even with computer-generated information. BPS makes no representation regarding the completeness, accuracy, or timeliness of such information and data, or that such information and data will be error-free. Visitors are encouraged to review the official version of all documents on which they plan to rely. The contents of this Portal are provided for information purposes only. BPS does not accept any liability to any person for the direct, indirect, incidental, special or consequential damages that result from the use or misuse of any information provided in this Portal. We do all that we can to protect information about participants and will never pass on individuals’ information to third parties. This privacy policy applies to the S&C Portal and to its online services. The purpose of this privacy policy is to inform you, cover what kinds of information we may gather about you when you visit and register, how we may use that information, whether we disclose it to anyone, and the choices you have regarding our use of, and your ability to correct, the information. Use of the hyperlinks and access to such linked websites are entirely the user's voluntary choice and responsibility. These external websites and their references to any specific commercial product, process, or service by trade name, trademark, or otherwise, do not constitute or imply endorsement, association, recommendation, or favoring by the Portal and the BPS. Conversely, external websites hyperlinking to the Portal do not constitute an endorsement or recommendation by BPS for these sites and their references to any specific commercial product, process, or service by trade name, trademark, or otherwise. It is understood that when the user hyperlinks to an external site, s/he has left the Portal and is now subject to the privacy policy of the new site and the information collected or used on the said site. All the hyperlinked sites shown in the Portal have passed through a predetermined screening process before being allowed to be posted in the Portal. This process is defined in the DTI Portal Implementing Rules and Regulations supporting DTI Department Order 47, Series of 2004. In general, other websites may link to this Portal with prior acknowledgment and approval from BPS. BPS must be explicitly identified and duly credited as the source of information displayed. Commenting/Discussion/Posting Rules By registering with the S&C Portal site you agree to abide by the following rules. "Netiquette" is online etiquette, or guidelines for online behavior. The most important thing to remember is to respect other visitors and posters to the forums. Please reply to other people comments constructively and respectfully. 1.You may not post off-topic, inflammatory, inappropriate, illegal, infringing, libelous, abusive, defamatory, obscene, or offensive material. 2.You may not post material that invades a person's privacy, violates any copyrights, violates any intellectual property rights, or that would otherwise violate any law. 3.You may not post material known to be false. 4.You may not post or transmit any information, software or other material that contains a virus or other harmful component. 5.The forums are not to be used in a commercial manner to post material that solicits funds, or that advertises or solicits goods or services. Please use the advertisement section of the site for such purposes. 6.Debate should be lively but also respectful. 7.Stay on-topic. Please don’t post messages that are unrelated to any forum. 8.Don’t incite hatred on the basis of race, religion, gender, nationality or sexuality or other personal characteristic. 9.Don’t engage in ‘spamming’. Please don’t add the same comment to more than one forum 10.Don’t advertise. You can mention relevant products and services as long as they support your comment. 11.Don’t impersonate or falsely claim to represent a person or organization. Please don’t mislead other users by abusing our registration procedure. 12.Don’t post in a language other than English. We hope in the future to be able to support translation. 13.Avoid being party political – this site is about consensus-building, not party political point-scoring. BPS will not be responsible for material appearing in any forum. The responsibility for accuracy and content of the messages posted remain with the poster. Whether or not we modify or remove such material, users remain solely responsible for the content of their messages. We retain the right to modify or edit and/or remove messages or other material that we consider off-topic, inflammatory, inappropriate, illegal, infringing, libelous, abusive, defamatory, obscene, offensive or otherwise unacceptable. Likewise, we reserve the right to edit materials for any other reason. If a comment contravenes the discussion rules it will not be published or removed from the forum. Posts may be returned to the participant by email, along with a reference to the broken rule(s). The participant will be invited to make appropriate changes in order that the post can be reconsidered. Virus protection BPS make every effort to check and test material at all stages of production. It is always wise for users to run an anti virus program on all material downloaded from the internet. BPS cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may occur whilst using material off this website. Intrusion Detection and Security For security purposes and constant availability of the Portal in the Web, BPS uses special software programs for monitoring network traffic to identify unauthorized attempts to upload or change information, or cause damage to the Portal. These programs collect no information that would directly identify individuals, but they do collect information that could help identify someone attempting to tamper with this website. If you use this system or Portal, you should understand that all activities may be monitored and recorded. Anyone using this system or Site expressly consents to such monitoring. This serves as a WARNING that if such monitoring reveals possible evidence or information of criminal or suspicious activity, monitoring records may be provided to law enforcement officials without any prior oral or written notice to the suspected user. Except for authorized law enforcement investigations, BPS makes no other attempts to identify individual users or their usage habits. BPS only uses raw monitoring data for logs to determine usage trends and diagnose system or Portal problems. Online Payments and Transactions In the advent of online payments and related transactions, BPS shall safeguard the user's personal information by using industry-standard data encryption technology designed to ensure the privacy of the user's information, name, address, e-mail, and other information provided to the Portal. This is to provide the user with a secure online experience within the Portal. Indemnity As a condition of the Portal use, the user and/or anyone linking to it agrees to indemnify the BPS against any and all liability, expenses (including attorney's fees and court costs) and damages arising out of claims, including, without limitation, any claims alleging facts that if true would constitute a breach of the terms and conditions stated in this TOU. Jurisdiction This TOU is governed by the laws of the Republic of the Philippines. The user and/or anyone linking to the Portal consents to the exclusive jurisdiction and venue of the courts in Makati City, Metro Manila, Philippines in all disputes arising out of or relating to the use of this website. The user/s of the Portal and/or anyone linking to it in jurisdictions of the courts outside of the Republic of the Philippines consent to the jurisdiction of the courts in the Republic of the Philippines. The Philippine Electronic Commerce Act of 2000 (Republic Act 8792) shall fully apply. Questions, Suggestions, Comments In the interest of improving the delivery of public service through the Web, BPS reserves the right to update or modify the Portal and/or its contents without prior notice.
